These Terms of Service (“Terms”) govern your use of historicaly.com and the genealogical research services provided by Historicaly LLC (“Historicaly,” “we,” “us,” “our”). By creating an account or purchasing a project, you agree to these Terms.

1. Who can use the Service
You must be at least 18 years old to create an account or purchase a project. If you are between 13 and 17, you may use the Service only with the consent and involvement of a parent or legal guardian who agrees to these Terms on your behalf.
You may create an account using an email address and password, or sign in with a supported third-party authentication provider (currently Google). You must provide accurate information when creating your account and keep that information current.
You may not use the Service if you are barred from doing so under the laws of your jurisdiction, or if your account has previously been terminated by us.
2. What we do
Historicaly is a genealogical research service. We locate historical records, transcribe and translate them, and compile the results into written research reports. Depending on the project you purchase, your report may include record images, transcriptions, English translations, narrative text, family charts, and maps.
Our research is based on historical records held by archives, libraries, churches, governments, and online repositories. We search these sources using the information you provide and deliver what we find.
3. What we don’t do
We are not a law firm. We do not provide legal advice. Our Citizenship Research product delivers genealogical records and publicly documented information about citizenship rules, not a legal opinion on your eligibility. You must consult a qualified attorney for legal advice on citizenship, immigration, inheritance, or any other legal matter.
We are not a certification authority. Research findings are for informational and family history purposes. They are not certified copies of public records. If you need a certified record for legal or official use, we will explain how to obtain one from the appropriate authority.
We do not guarantee outcomes. Genealogical research is inherently uncertain. Records may be missing, damaged, destroyed, or incorrect. The information in historical records is only as reliable as the person who recorded it. We make no guarantee that we will find a specific record, prove a specific relationship, or reach a specific conclusion.
4. Accuracy and limitations of research
Our research is based on our best interpretation of available historical evidence. However:
- Historical records can contain errors. Names were commonly misspelled, dates estimated, and relationships mislabeled.
- Multiple individuals with the same name can exist in the same time and place. We use contextual evidence to identify the correct person, but misidentification is always possible.
- Translations involve interpretive choices. Archaic spellings, abbreviations, and handwriting ambiguities sometimes admit of more than one reading.
- Some records cited in our reports may no longer be accessible to verify.
We encourage you to treat our findings as thoroughly researched starting points rather than final proofs. We welcome corrections and questions from users who identify potential errors. For legal matters, always have our findings reviewed by a qualified professional.
5. Payment and refunds
Pricing. Prices for each product are displayed on the Service at the time of purchase. We reserve the right to change prices for future orders; changes do not affect orders already placed.
Payment processing. Payment is processed by Stripe. You authorize us to charge the payment method you provide for the project you purchase.
Refund policy. Our refund policy is detailed in the FAQ section of our Service and incorporated into these Terms by reference. In summary:
- Full refund if we find no relevant records for your target person or family.
- Full refund if a Find a Record search couldn’t locate the specific record you ordered.
- Automatic $20 refund if a Historical Retrieval ($59) could only be fulfilled as a Document Location ($39).
- Full refund or corrected report if we made a factual error.
- For partial results on a larger project, we’ll look at what we delivered against what we set out to find and figure out what’s fair — that might be a partial refund proportional to the gap, or additional research at no extra charge. We make this call as a person reviewing the project, not as a formula.
- Full refund if you change your mind before research has started.
- No refund when records were found and delivered accurately but the results were fewer or different than hoped.
Refunds on self-purchased projects are processed to your original payment method. Refund-equivalent outcomes on a project that was started from a redeemed gift card are handled as account credit rather than a cash refund — see Section 6.

Taxes. Prices do not include sales tax, VAT, or other applicable taxes unless otherwise stated. You are responsible for any taxes imposed by your jurisdiction.
6. Gift cards and account credit
Gift cards
You may purchase a gift card for any of our services (other than custom-quoted work). A gift card is a pre-paid purchase of a specific product, intended to be redeemed by a recipient you choose.
- Validity. Gift cards are valid for 12 months from the date of purchase.
- Delivery. When you purchase a gift card, you receive it by email. You may choose to have the gift card sent to you immediately, or schedule it to be sent at a future date and time you select (for a birthday, holiday, or other occasion). You may forward, print, or share the gift card with your recipient however you like.
- Redemption. The recipient redeems the gift card by entering its code on the Service. Upon redemption, the recipient becomes the owner of the resulting project — they provide the research details and the report is delivered to their account. A gift card code can be redeemed only once and is tied to the account that redeems it.
- Cancellation and refund. You may cancel an unredeemed gift card within 30 days of purchase for a full refund to your original payment method. After 30 days, a gift card cannot be canceled or refunded; it remains valid until its 12-month expiry. If a gift card is not redeemed before it expires, it expires without refund — the same way most service gift certificates work.
- Non-transferable codes. A gift card code is single-use and, once redeemed, is permanently associated with the redeeming account.
Account credit
Account credit is a dollar-value balance on your account that can be applied toward the purchase of any project, reducing the amount charged at checkout. Credit is not cash: it cannot be withdrawn, transferred, or converted to cash, and it has value only within the Service.
- How credit is granted. Credit may be granted to your account in two main ways: (1) when a project you started from a redeemed gift card reaches an outcome that would normally warrant a refund (for example, no relevant records were found), the value is granted to you as account credit rather than refunded as cash — because the original purchase was a gift, the value stays with you to apply to another project; and (2) at our discretion, as a goodwill gesture (for example, in connection with a service issue).
- How credit is applied. Available credit is applied automatically at checkout, reducing the amount charged to your payment method. If your credit covers the full price, no charge is made. If your credit is less than the price, the remainder is charged to your payment method. If your credit exceeds the price, the unused balance remains in your account. Credit may be applied toward any project, including one priced higher than the credit balance (you pay the difference).
- No expiry. Account credit does not expire.
- Non-transferable. Credit is tied to your account and cannot be withdrawn, transferred to another account, or converted to cash.
7. Ownership of reports
You own your research report. Once we deliver a project and you’ve paid for it (or redeemed a gift card or applied credit toward it), you may share, print, publish, and use the report for any personal or commercial purpose.
We retain ownership of the underlying research methodology, database selection logic, software, and the form and design of the Service itself. Nothing in these Terms transfers our intellectual property to you.
Our use of research outputs. We may use aggregated, de-identified patterns from our research (for example: which databases produced the most valuable results for Polish surnames) to improve the Service. We do not share individual family information, and we do not use your specific research outputs to train external AI models or for any purpose that would expose your data outside the Service.
8. Acceptable use
You agree not to:
- Use the Service to harass, stalk, investigate, or gather information about a living person without their knowledge or consent.
- Upload material that infringes third-party intellectual property rights (for example, records you obtained under licenses that prohibit redistribution).
- Use the Service for any unlawful purpose.
- Attempt to circumvent authentication, access accounts you do not own, or probe the Service for security vulnerabilities outside of a coordinated disclosure program.
- Resell the Service or use it to provide competing services.
- Upload or submit content that is obscene, defamatory, or otherwise objectionable.
We reserve the right to suspend or terminate accounts that violate this policy. Serious violations (for example, using the Service for stalking) may be reported to law enforcement.
9. Your content
You retain ownership of the information and documents you upload to the Service. By uploading content, you grant us a limited license to process that content solely for the purpose of delivering the research project you’ve purchased. This license ends when you delete your account or the specific content, except to the extent we are required to retain backup copies for a limited period (see our Privacy Policy).
You represent that you have the right to upload any content you submit. If you upload documents owned or licensed by a third party (such as church records from an archive with usage restrictions), you are responsible for complying with those terms.
10. Account termination
By you. You may delete your account at any time from account settings. When you initiate deletion, your account enters a 48-hour grace period during which you can recover it by clicking the link in the recovery email we send. After 48 hours, your account and associated data are permanently deleted, subject to the limited retention exceptions described in our Privacy Policy.
Deleting your account forfeits any unused account credit and any unredeemed gift cards you have purchased that remain in your account. If you have an unredeemed gift card you wish to preserve or transfer to a recipient, do so before deleting your account.
By us. We may suspend or terminate your account for:
- Violation of these Terms
- Fraudulent activity
- Non-payment of fees
- Legal requirement
- Extended inactivity (generally, no login for 24 months — we will email you first and give you at least 30 days to keep the account active)
Where feasible, we will provide notice and an opportunity to address the issue before termination. After termination, your research reports may no longer be accessible. We recommend downloading important reports to your own storage.
11. Disclaimers
THE SERVICE AND REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HISTORICALY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that research findings will be accurate, complete, or satisfy any specific need you have — including legal, immigration, or citizenship needs.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HISTORICALY’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
WE WILL NOT BE LIABLE FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow limitations on implied warranties or liability for incidental or consequential damages, so some or all of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Historicaly and its officers, employees, and contractors from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Service in violation of these Terms, (b) your misuse of research reports, including any use that violates applicable law, and (c) content you upload that infringes the rights of a third party.
14. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or the Service shall be resolved in the state or federal courts located in Wyoming, and you consent to the jurisdiction of those courts.
For users in jurisdictions where mandatory consumer protection laws apply (including many jurisdictions in the European Union), nothing in this section affects rights you have under those laws.
Informal resolution first. Before filing a formal claim, please contact us at legal@historicaly.com. Most disputes can be resolved informally, and we will work in good faith to address your concerns.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email and post a notice on the Service at least 30 days before the changes take effect. Continued use of the Service after changes take effect means you accept the updated Terms. If you do not accept them, you may delete your account before they take effect.
16. Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy and any purchase-specific terms presented at checkout, constitute the entire agreement between you and Historicaly regarding the Service.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
No waiver. Our failure to enforce any right or provision does not waive that right or provision.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Survival. Sections 3, 4, 6, 7, 9, 11, 12, 13, and 14 survive termination of your account.
